Scope
An accounting route, not an exemption.
Projects of recognised national scale, major infrastructure, certain industrial and defence facilities, have their land consumption accounted at national level rather than charged to the local envelope. The purpose is to prevent a national project from consuming a small commune's entire allocation.
It is an accounting arrangement and nothing more. The project remains subject to the whole environmental file: impact assessment, ecological procedures, water, acoustics. Reading it as an exemption from the trajectory is the most common misunderstanding.
Qualification
The list is closed, and the burden of proof sits with the project.
Qualifying is not a matter of arguing that a project is important. The categories are defined and the demonstration is documentary, examined by the State. A project that assumes it qualifies and builds its programme on that assumption carries a risk it has not priced.
Even where it qualifies, the local planning documents still govern what may be built where. National accounting does not override local land-use rules.
Consequence
National accounting does not remove local opposition.
Charging land consumption to a national envelope changes an accounting line. It does not change the public inquiry, the environmental authority's published opinion, or the capacity of associations to challenge the authorisation. Projects that treat the derogation as a shortcut through the process discover this at the inquiry.
The environmental file therefore remains the determining document, and its quality, particularly its treatment of cumulative effects, decides the outcome as it would for any other project.
