Grounds
Three routes, each requiring a technical file.
A modulation of the reduction trajectory can be sought on three grounds: technical constraints, including heritage protection, a change in the intensity of use of the building, or disproportionate cost measured against the benefit. Each is a distinct demonstration, and the burden of proof sits entirely with the declaring party.
Disproportionate cost is the ground most often invoked and the most often insufficiently evidenced. It requires a costed study of the actions considered and their payback, not an assertion that the works would be expensive.
Timing
Substantiate early, because the file rests on history.
A modulation file is built from the same consumption series as the declaration, which means the data has to exist before the argument is needed. Owners who decide at the deadline that they will seek a modulation discover that the supporting record is three years short.
Intensity of use is the ground most relevant to buildings whose occupancy has changed structurally, offices under hybrid working, facilities whose activity has grown, but it requires the change to be documented, not narrated.
Alternative
Modulation is not the only route.
Before building a modulation file, it is worth testing whether the trajectory is genuinely unreachable. Buildings frequently consume more than they need for reasons that are cheap to correct, controls left at default settings, schedules that no longer match occupancy, equipment running continuously. These are found by measurement, not by assumption.
Where correction closes the gap, it is faster and cheaper than substantiating a modulation, and it produces a result rather than an exemption.
